In a recent interview on Arise TV’s morning show, constitutional lawyer Ewa Okpo criticized the actions of the Economic and Financial Crimes Commission (EFCC) in its ongoing confrontation with former Kogi State Governor, Alhaji Yahaya Bello, labeling it as “trial by mischief.” Okpo highlighted the inappropriate nature of EFCC’s attempt to arrest Bello despite the existence of a restraining order, which had not been lifted at the time of the incident.
Describing the situation as an abuse of the court process, Okpo outlined the legal procedures that should have been followed by the EFCC in prosecuting Bello. He emphasized the importance of adhering to constitutional and statutory laws, including the Constitution, the Administration of Criminal Justice Act, and the EFCC Act, among others.
According to Okpo, the EFCC should have first officially invited Bello for questioning, and if he refused to comply, administrative powers could have been used to issue a warrant for his arrest. However, instead of following these steps, the EFCC attempted to arrest Bello without proper legal justification.
Despite Bello’s swift action in obtaining a court order restraining the EFCC, Okpo criticized the anti-corruption agency’s disregard for the court’s decision. He emphasized the importance of respecting court orders and called for greater accountability within law enforcement agencies.
Okpo praised the court’s intervention in the matter, highlighting its role in ensuring that law enforcement agencies operate within the bounds of the law. He stressed the need for the EFCC to uphold the rule of law and refrain from taking actions that undermine the judicial process.
